NPB Free Agency Clause, Current Collective Agreement?

You can find the current MLB-NPB agreement here [JBPBA Official Site].

Unfortunately, that document doesn't have what McLeod-san is looking for - the free agency time limits.

The document he is looking for is The Baseball Agreement [in Japanese]. Chapter 22, starting on Page 40, is the relevant section regarding free agency.

I had translated a number of sections of The Baseball Agreement before, but spammers saw to it that the Pro Yakyu Wiki was rendered useless. I'll see if I can recover anything that may be useful.

I was unable to find a translation, so I'll post the paragraphs in their original Japanese form below, and translate them as I have time. If anyone else wishes to lend a hand, it'll be greatly appreciated.

第196条 (FAの定義)

日本プロフェッショナル野球組織にフリーエージェント(以下FAという)制度を設ける。FAとは、同組織が定める資格条件を満たした選手のうち、いずれの球団とも選手契約を締結できる権利を有する選手をいう。

第197条 (資格取得条件)

選手は入団して初めて出場選手登録された後、その日数がセントラル野球連盟およびパシフィック野球連盟の同じ年度連盟選手権試合期間中(以下シーズンという)に145日を満たし、これが9シーズンに達したときに、FAとなる資格(以下FA資格という)を取得する。

Article 197 (Conditions for Acquisition Qualification)

1. After a player has first been registered for a given team, during the number of days during the period of time in which the Central League and/or Pacific League conduct their competitions (hereinafter referred to as a "season") satisfying 145 days, once 9 seasons have been reached, the player is said to acquire the qualification for free agency (hereinafter referred to as "FA qualification").

2. When a player is not registered for the full 145 days during a given season, the total number of days are tallied up, then one season is counted when the sum surpasses 145 days.

Note: With regard to both the Central League and Pacific League, the initial date concerning a participating player's registered days for FA qualification in regular season play, as regarded to Article 84 of The Baseball Agreement, shall be the initial date for the start of the specific league.

第198条 (コミッショナーの公示)

コミッショナーは毎年、セントラル野球連盟およびパシフィック野球連盟の年度連盟選手権試合が終了した後、いずれか遅い方の終了日の2日後に、その年にFA資格を得た選手およびFA資格を持続している選手の名簿を公示する。

第199条 (権利行使)

その年FA資格を取得している選手(以下FA資格選手という)がFAの権利を行使するためには、本協約第201条の1号に定める期間内に行使することを表明し、手続きをとらなければならない。所定の期間内に手続きをとらない場合は、FAの権利の行使を保留したものとする。

コミッショナーは、FAの権利を行使する旨文書で申請のあった選手(以下FA宣言選手という)名をその年の日本選手権シリーズ試合が終了した日の翌日から土、日、祭日を除く7日間を経た翌日の午後3時にFA宣言選手として公示する。[1997.10.7改正]

(2)

FAの権利を行使する意志を表明したFA資格選手は、第1号に規定する期間内に、在籍している球団代表者と連名によりコミッショナーあてその旨文書で申請しなければならない。

第202条 (選手契約の条件)

FA宣言選手と選手契約を締結する球団は、当該選手の参稼報酬年額を日本プロフェッショナル野球組織に所属する球団での同選手の直前シーズンの統一契約書に明記された参稼報酬年額(以下前参稼報酬年額という)を超える額とすることはできない。[2000.7.17改正]

ただし、球団が当該選手の前参稼報酬年額およで稼働成績にかんする特別な事情をコミッショナーに文書で申請し、コミッショナーがこれを認めた場合は、本条の制限を超える参稼報酬年額で選手契約を締結することができる。[1997.10.7改正]

第203条 (FA宣言選手の参稼報酬の減額制限)

FA宣言選手が選手契約を締結する場合は、第92条(参稼報酬の減額制限)の規定にかかわらず、当該選手の前参稼報酬年額から25%を超えて減額することもさまたげない。[2000.7.17改正]

In the event that a player who declares free agency enters into contract negotiations with a team, the provisions of Article 92 (maximum reduction of players' remuneration) shall not prejudice the right to reduce the amount of such player's remuneration by more than 25% of the amount of his previous year's remuneration for services.

第204条 (金銭調停の不請求)

第205条 (球団の補償)

日本プロフェッショナル野球組織に所属する他の球団に在籍していたFA宣言選手と選手契約を締結した球団は、当該選手の旧球団にたいし金銭および選手を補償しなければならない。[2000.7.17改正]

(1) 金銭による補償は、当該FA宣言選手が最初のFAの権利行使の場合は旧球団と契約した統一契約書に明記された前参稼報酬年額の80%、反復のFAの権利行使の場合は旧球団と契約した統一契約書に明記された前参稼報酬年額の40%とする。[2000.7.17、2001.9.21、2003.7.7改正]

(2) 選手による補償は、当該FA宣言選手と選手契約した球団が保有する支配下選手のうち、外国人選手および同球団が任意に定めた28名を除いた選手名簿から旧球団が当該FA宣言選手1名につき各1名を選び、獲得することができる。前記の選手名簿の旧球団への提示はFA宣言選手との選手契約締結がコミッショナーから公示された日から2週間以内に行う。選手による補償が重複した場合は、当該FA宣言選手と選手契約した球団と同一連盟の球団が他の連盟の球団に優先する。また同一連盟内においては、当該年度連盟選手権試合の勝率の逆順をもって、球団の優先順位とする。[2000.7.17、2003.7.7改正]

ただし、旧球団が選手による補償を求めない場合は、前記1号の金額に50%を加算した金額の補償をもって、選手による補償にかえることができる。

補償例
最初のFAに対するもの
• 人的補償あり=旧年俸の80%
• 人的補償なし=旧年俸の120%
反復のFAに対するもの
• 人的補償あり=旧年俸の40%
• 人的補償なし=旧年俸の60%

(3) 前記1号、2号すべての補償は、コミッショナーから当該選手の契約締結の公示が行われた後、40日以内に完了しなければならない。ただし、金銭による補償については、旧球団の同意がある場合は、期間を延長することができる。

(4) FA宣言選手がFA宣言した年の翌々年の11月30日まで日本プロフェッショナル野球組織に所属するいずれの球団とも選手契約を締結せず、FA宣言した年の翌々年の12月1日以降、日本プロフェッショナル野球組織に所属するいずれかの球団と選手契約を締結した場合、そのFA宣言選手と契約した球団は旧球団にたいしての補償を必要としない。

第206条 (球団の獲得選手数)

球団がFA宣言選手のうち直前シーズンまで日本プロフェッショナル野球組織に所属する他の球団に在籍していた選手と次年度の選手契約を締結できるのは2名までとする。

ただし、公示されたFA宣言選手数が21名から30名の年度は3名まで、同31名から40名の年度では4名まで、同41名以上の年度では5名まで選手契約を締結することができる。

Article 206: Number of players teams may acquire

A team may sign to a contract for the next season no more than two players who have declared free agency and who were signed to another team belonging to the Nippon Professional Baseball Organization up to and including the immediately preceding season.

However, such team may contract not less than three free-agent players in years when the total number of players declaring free agency is between 21 and 30, not less than four free-agent players in years when the total number of players declaring free agency is between 31 and 40, and not less than five free-agent players in years when the total number of players declaring free agency is 41 or greater.

第207条 (FA宣言選手の稼働期間)

FA宣言選手と公示された選手といえども、当該選手が旧球団とかわした統一契約書により11月30日までは旧球団および日本プロフェッショナル野球組織が指定する行事に参加する義務を負う。

Article 207: Terms of service of players declaring free agency

Any player that declares free agency and is officially announced as so must, notwithstanding his free agent status, still participate in events specified by his former team and the Nippon Professional Baseball Organization up to and including November 30 of the pertinent year in accordance with such player's contract with such former team.

The article or articles most interested in are the follow ups to Article #196 which states "qualifying conditions stipulated by the organization." It is those specific conditions relating to service time that have my most interest, and again my thanks for your work in helping me find this important information.
